29 Jul Telephone Consumer Protection Act of 1991
This act prohibits certain types of calls and regulates the hours of calls. The Act prohibits calls before 8am or after 9pm. It also restricts the types of calls that can be placed by autodailers or automated phone systems.
If you are being harassed the phone call must provide the following:
1. Name of person or entity making call;
2. Who the call is made on behalf of;
3. A telephone number or address of how to reach the caller.
If you request to be put on a do not call list, the telemarketer must comply with this demand right away. If a telemarketer violates this act they can be subject to $1500.00 in damages for each violation.
If you are tired of receiving these types of calls you can register with the do not call list 1-888-332-1222. This list has over 209 million phone numbers listed.
The other issue to watch out for are scams from people calling wanting your personal information.
If you are receiving these types of calls you do not have to take the abuse, in many cases the robot calls come not stop to phones once they get your phone number.
The exception to the above rules is if you have given prior written permission for the caller to contact you. In most cases the robo call does not have permission for the phone call, so they are just out to harass you, through the telephone.
The other prohibited behavior is the fax that is not requested or wanted. It is illegal to send junk faxes to parties who do not wish to receive the faxes. This happens all the time with faxes saying you have won a vacation or can get some cash. In most if not all of these cases this is a scam and should be avoided.
Many states also have rules that regulate this type of behavior by telemarketers. The state laws in some cases mirror the federal law, and in some cases surpass the federal law. The best way to prevent some of these calls and faxes is not give out the information in the first place.
